Breathwork Liability Waiver
Release of Liability, Waiver and Assumption of Risk Agreement
In consideration of being allowed to participate in Breathwork, as well as activities with SENSOPHY, (hereinafter collectively “the Activities”) I hereby acknowledge, understand and agree to the following:
Breathwork may result in dramatic energetic, physical and emotional release. It is not recommended for persons with a history of cardiovascular disease, those with cardiac arrhythmia (including slow heart rate), history of heart block, epileptic seizures, retinal detachment, high blood pressure, glaucoma, significant recent physical injuries or surgery.
Breathwork is not recommended for persons with extreme mental illness, or for persons using antipsychotic medications or history of aneurysms. Both persons with asthma and women who are pregnant are advised against practicing until they consult with their primary care physician.
(1) I HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS SENSOPHY and its employees, agents, representatives, team members, as well as its owners, principals, and representatives (hereafter collectively “SENSOPHY RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, whether physical, mental, psychological or emotional, or ANY LOSS or DAMAGE to PERSON or PROPERTY, of any kind, WHETHER ARISING FROM THE NEGLIGENCE OF SENSOPHY RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
(2) I am here to inspire my own personal transformation. I take personal responsibility for my well-being and with respect for myself I gratefully accept control of my choices. My heirs, guardians, legal representatives, and I hereby and forever release, waive, and discharge any claims against, “SENSOPHY RELEASEES” and/or any of their associates or affiliates. I take full responsibility and am responsible for all liability for loss or injury incurred while in association with the Activities.
(3) I agree to defend, indemnify, and hold harmless SENSOPHY RELEASEES for all costs and expenses, including but not limited to all legal fees incurred by SENSOPHY RELEASEES in defending any claim brought against any or all of SENSOPHY RELEASEES.
(4) I fully understand that there are physical and inherent risks involved in the Activities, including the risk of serious injury and death. I fully assume all risks associated with the Activities, including: intensive activity and exertion, causation or aggravation of a physical injury or medical condition, lack of warnings or inadequate warnings; lack of instructions, inadequate instructions, or my failure to follow instructions. I am fully aware of and accept the risks and hazards involved, and agree to assume full responsibility for any risks, conditions, injuries or damages, known or unknown, which I might incur or aggravate as a result of my participating in the Activities.
(5) I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Activities. I represent and warrant that I am physically, mentally and emotionally fit and I have no medical condition that would prevent my full participation in the Activities and that I will fully inform SENSOPHY RELEASEES if I feel any pain or discomfort or have any medical or pre-existing condition that would prevent my participation or increase the likelihood of injury.
(6) In consideration of being permitted participation in the Activities, classes, workshops or programs offered by SENSOPHY RELEASEES, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the Activities.
(7) In further consideration of being permitted to participate in the Activities, I knowingly, voluntarily and expressly waive any claim I may have against SENSOPHY RELEASEES for injury or damages that I may sustain as a result of participating in the Activities now and in the future.
(8) I agree to comply with the stated and customary guidance and norms of participation in the Activities.
(9) If I am pregnant or am post-natal, I will not participate in the Activities without first discussing the risks with my primary care physician, and I will only participate in the Activities if I have my doctor’s full approval. I will not hold the SENSOPHY RELEASEES responsible for any injuries to my pregnancy caused in part or in whole by my failure to follow my doctor’s recommendation.
(10) I hereby forever and irrevocably waive and release any and all claims I now have or may in the future have against SENSOPHY RELEASEES with respect to any injury, loss or damage I suffer as a result of participating in the Activities. I understand and agree that this Release of Liability, Waiver and Assumption of Risk Agreement extends to and includes any and all damages, injuries, and claims which I do not anticipate or know to exist and to any and all damages, injuries, or claims which may develop in the future, and I hereby expressly waive and relinquish any and all rights under any law or statute to the contrary.
(11) I understand that this waiver can be used for future classes, workshops or programs with SENSOPHY RELEASEES.
(12) If participant is under the age of 18, I as a LEGAL GUARDIAN CONSENT TO THE ABOVE TERMS AND CONDITIONS.
(13) I have carefully read this agreement and fully understand its content. I am aware that this is a waiver and release of potential liability and a contract between the above noted parties and myself. I understand that this contract is binding and acknowledge that I am signing this of my own free will, voluntary without any inducement. I understand that there exist known and unknown dangers of serious injury and death associated with the Activities, some of which are referenced above, I nevertheless choose to participate in the Activities and have waived all right to maintain suit against any of SENSOPHY RELEASEES.

The ladder concept has helped me tremendously since it was first introduced to me a few months ago. I sometimes can get so caught up in a situation and so in my head about ‘What does this mean, what do I do?’ etc. that I don’t realize that my thoughts and my heartbeat are going a thousand miles a minute.. it’s no wonder why I can’t get out of that impending doom space or make any decision at all. Asking myself that question “Where am I on the ladder?” allows me to pump the breaks, pause and check in with myself, how I was feeling and move forward with some action to change that.
What I’ve been doing for the last couple of months in combining my love for walking/hiking with singing and dancing. It’s soo much fun lol. Nothing like a little jam out session in my car on my way to my next appointment. I bought some concert tickets this summer…going by myself with the sole purpose to do some L.S.D.! It is healing… 🙂

Love the simplicity of thought behind this tool- being in a shitty place whilst making decisions, leads to shitty outcomes/consequences. Sometimes talk about raising awareness/consciousness becomes too esoteric and abstract. I love how this ladder tool is so practical and common sense- think about the rung you’re on and then wait til your state of mind is positive before you decide/act and your choices will always be good.

Yes!! Finally someone understands what I mean! I’ve been using this tool without really understanding it’s an actual tool to help you out in life, but simply because when ever I do something I love in a situation where I’m feeling negative feelings and stress, it makes my mind clear and takes that extra noise out of your body so that you can listen to your heart (intuition) again. Jacob, you’re awesome!

Jacob, completely agree! I have found that whenever I’m in a bad mood it generally means I need to take that time out for myself; just stop and tune in to what is causing me to be moody or upset. I like the concept of not making decisions when I am in that state, and I will make sure to use that next time I am feeling out of sorts about a situation… 🙂

Instead of tuning into what’s causing you to be upset… just stop thinking about it completely for the time being.
Go exercise, meditate, dance, have a great conversation focusing on someone else, etc.

As you know Jacob, in the ideas of good or bad, there is no such distinction in the world of philosophy. We either make good or not good decisions based on how we perceive the results of those decisions, which change our lives. Ultimately, it all boils down to experience. And if, like you say, we are all on our way to light, then enlightenment is what we receive from these decisions. Back to your video. Yes, it is much better to make a decision from a better place in our minds. Treating ourselves to some time in nature or nourishing our bodies helps us make important decisions. This is really great advice. I am sure your network of like-minded readers will agree. Great post!

I experienced this today. I’m struggling with a major decision and feeling overwhelmed by it. I was in my head, feeling negatively emotional and surrounded by fear. I went out and spoke with a friend, had some laughs and when I came home, the decision seemed much easier and I actually took some action steps. I wasn’t aware of the ladder principle but it makes sense. Thanks for the video.

I like that idea, but sometimes I think that people bring others down. You know I was listening to some podcast and the guy was talking about crabs and how sometimes fisherman catch the crabs. So some crabs are caught, and then all of a sudden some other crabs jump in the net with them (shocking, yeah) but it doesn’t stop there. Sometimes some crabs want to get out of the net, and the other crabs hold them back, and sometimes even break their legs if they’re trying to get out of the net.
So, even if someone’s trying to get themselves into that higher frequency of thought, how do you deal with the haters/naysayers//doubters/over critical/negative people (especially of things that don’t matter like height or something like that)?

The first thing I’d realize is that nobody has the power to bring you down.
They can take everything away from you *physically*, but they can never take away anything from you *mentally* and *spiritually*.
In other words, they can’t take away your ability to choose how you respond to the situation. And that response can always be an empowering one (one that gives you power instead of takes it away from you).
Makes me think of some classic Victor Frankl (who was a holocaust survivor and one of the leading psychologists of the 20th century)…
“Everything can be taken away from a man but one thing: the last of the human freedom — to choose one’s attitude in any given set of circumstances, to choose one’s own way.”

On another note, I’m a huge fan of doing WHATEVER it takes to make sure you’re only spending time with people who treat you well and help you grow.

And the distinction I would make is the we DO wanna take action while we’re in a “bad” mood… but we wanna make that actions something that will help our mood right now.
Then once our mood is better, we can make the bigger decisions!
It’s a great advice. I tend to make major decisions from a place of inspiration and trust and I never regret them.
However, _following through_ is a bitch. I have some mood issues, tendency to procrastinate, self-sabotage etc. So it looks like this: I choose my dream studies, against everyone’s advice, I have a great plan, I take additional courses, etc. Last year I had a full-time job, part-time studies, second studies! (a coaching course), plus extracurricular student activity that took a lot of time. It all were great decisions, made in a great consciousness, and for a long time I managed to do it all at once.
However, because of my weak day-to-day myself that makes small everyday decisions (not the major ones), now I have serious troubles at my dream studies, I stopped coaching, I dropped the student activity, and I was recenty fired.
It’s like… I can pretend I’m wise, fearless and courageous at the short time of making the major decision, but I can’t predent this on a daily basis, and following through is what makes these decisions count. So maybe it would work out better if just was my normal self at the time of making the decision?
